Subletting in Germany: What’s Allowed and What Isn’t
Subletting (Untermiete) can be a flexible solution if you’re going abroad temporarily or want to share your flat. But there are rules.
Do you need permission?
In many cases, you need written permission from your landlord to:
Sublet a room long-term
Sublet the entire flat for a period (e.g. several months)
Your contract may describe how to request permission. Landlords cannot arbitrarily refuse in all situations, but there are limits.
Subtenant contracts
Always create a simple subtenant contract that includes:
Names and address
Start date and rent amount
What’s included (furniture, bills)
Notice period
House rules
Remember: as the main tenant, you remain responsible to the landlord.
Short-term and holiday rentals
Turning your flat into a holiday rental (e.g. via platforms) is heavily regulated, especially in big cities. You often need explicit permission and sometimes official permits. Ignoring this can lead to serious fines.
